These Terms of Service govern access to and use of Pewly. Pewly provides church attendance, member-care, communication, and administrative tools.

In these Terms, “Pewly,” “we,” “us,” and “our” refer to Pewly, 3050 Yorkville St, London, ON N6P 0J3, Canada. “You” means the person using Pewly and, where that person is acting for a church or another organization, that church or organization as well.

Acceptance of these Terms

By creating an account, accepting an invitation to a Pewly workspace, or otherwise using the service, you agree to these Terms and Pewly's Privacy Policy.

If you use Pewly on behalf of a church or another organization, you represent that you have authority to accept these Terms on its behalf. If you do not agree to these Terms, you must not use Pewly.

About Pewly

Pewly is a church-management and member-care platform. Depending on the features currently available, it may help churches:

  • Manage member, visitor, and household records.
  • Record attendance and support public or usher-assisted check-in.
  • Review attendance and engagement trends.
  • Identify members who may need follow-up care.
  • Manage prayer requests and follow-up activity.
  • Send email and text-message reminders.
  • Manage services, team members, roles, and permissions.
  • Import and export church records.

Pewly may improve, replace, add, or remove functionality as the service develops. Features described as planned, upcoming, or in development are not part of the service until Pewly makes them available.

Account eligibility and responsibilities

You must be legally capable of entering into a binding agreement to create or use a Pewly account.

You agree to:

  • Provide accurate and current account information.
  • Keep your login credentials secure.
  • Use your account only for authorized purposes.
  • Promptly notify Pewly if you believe an account has been compromised.
  • Keep team access and role assignments current.
  • Remove or revoke access when a team member should no longer use the church's workspace.

Churches are responsible for the team members they invite and authorize. Different roles have different permissions, and church administrators are responsible for assigning appropriate access.

You must not share credentials in a way that allows an unauthorized person to use another person's account.

Acceptable use

You may use Pewly only for lawful church-management, attendance, communication, and care-related purposes. You must not:

  • Use Pewly for illegal, fraudulent, deceptive, or harmful activity.
  • Enter, import, or use personal information without appropriate authority or permission.
  • Send spam or communications that violate applicable email, text-message, privacy, or anti-spam laws.
  • Attempt to access another church's workspace or data.
  • Circumvent or interfere with Row Level Security, role restrictions, rate limits, duplicate-send protections, invitation safeguards, or other security controls.
  • Probe, scan, or test the service for vulnerabilities without Pewly's written permission.
  • Introduce malware, harmful code, or disruptive automated traffic.
  • Use scripts, bots, or automated requests in a way that overloads or disrupts the service.
  • Impersonate another person or misrepresent your relationship with a church.
  • Copy, resell, sublicense, or commercially exploit the platform except as expressly permitted.
  • Reverse engineer or attempt to extract Pewly's source code except where applicable law expressly permits it.

Pewly may investigate suspected misuse and take reasonable steps to protect the service, its users, and church data.

Church-submitted content and data

Churches retain ownership and control of the information and content they submit to Pewly, including member and visitor records, attendance information, prayer requests, follow-up notes, service details, church branding, and communications. Pewly does not claim ownership of this church-submitted content.

You give Pewly a limited, non-exclusive permission to host, store, process, back up, display, and transmit that content as reasonably necessary to:

  • Provide and operate the service.
  • Deliver communications requested through the service.
  • Maintain security and prevent misuse.
  • Provide support.
  • Comply with legal obligations.

This permission lasts while the content is held through the service, including any reasonable retention period described in the Privacy Policy.

The church is responsible for:

  • The accuracy and legality of its submitted content.
  • Deciding what member and visitor information should be collected.
  • Providing appropriate privacy notices.
  • Obtaining any consent or authorization required to collect, import, use, or communicate with people.
  • Ensuring that youth or children's information is entered and managed with appropriate parental or guardian authorization.

Pewly processes church-controlled member and visitor information on the church's behalf. Pewly's handling of account, support, security, analytics, waitlist, and marketing-consent information is explained in the Privacy Policy.

Privacy and security

Pewly's collection, use, storage, disclosure, and protection of personal information are described in its Privacy Policy.

Pewly uses technical and organizational safeguards, including role-based access and database Row Level Security, to limit access between church workspaces. No internet-based service can guarantee absolute security.

Churches remain responsible for using Pewly in compliance with the privacy, communications, and recordkeeping laws that apply to them.

Subscription, trial, and billing

Pewly currently advertises one plan at $49 USD per month. Every feature Pewly has made generally available under the current plan is included; Pewly does not currently use paid feature tiers or member-count pricing.

A planned annual option is advertised at $490 USD per year.

Pewly's billing system has not launched yet. At present:

  • No payment card is required to start using Pewly.
  • Pewly does not automatically charge users.
  • There is no automated subscription renewal.
  • There is no self-service billing or cancellation portal.
  • Creating an account or accepting these Terms does not authorize Pewly to charge you.

The seven-day trial begins when the church's workspace is created. Trial expiry does not currently disable the workspace or end access automatically. Pewly will contact the church before any paid arrangement begins.

When automated billing launches, Pewly will disclose the applicable payment, renewal, cancellation, tax, and refund terms before collecting payment. A church will not be enrolled in automated billing solely because it previously created a Pewly account.

Pewly may change future pricing or plan structure. Any change affecting an existing paid arrangement will be communicated before the new price applies.

The billing owner can close a church workspace from Settings. Closure immediately disables team access and public pages but preserves the workspace data. It cannot be reversed through the app; a verified restoration request must be handled manually by Pewly support. You can also contact [email protected] for help.

Intellectual property

Pewly owns the platform and its associated software, source code, design, documentation, branding, trademarks, logos, and other intellectual property, except for content owned by churches, users, or third parties.

These Terms give you a limited, non-exclusive, non-transferable right to access and use Pewly for your church's internal operations while your account remains authorized. They do not transfer ownership of the Pewly platform or its intellectual property to you.

If you voluntarily provide feedback or suggestions about Pewly, you permit Pewly to use that feedback to improve the service without an obligation to compensate you.

Service availability

Pewly is a growing platform and does not currently offer a service-level agreement or guaranteed uptime.

The service may occasionally be unavailable, delayed, or limited because of:

  • Maintenance or product changes.
  • Software defects.
  • Internet or infrastructure problems.
  • Outages affecting third-party providers.
  • Security incidents or protective measures.
  • Events outside Pewly's reasonable control.

Pewly does not guarantee that reminders, emails, text messages, check-ins, alerts, analytics, or follow-up detections will always be delivered, recorded, complete, or error-free.

Pewly is intended to assist a church's care processes. It does not replace the church's own judgment, pastoral responsibility, recordkeeping practices, or responsibility to follow up with people. Churches should retain appropriate copies of records they cannot afford to lose.

Suspension and termination

You may stop using Pewly at any time. Because self-service church cancellation and deletion are not currently available, requests to close a church workspace must be sent to [email protected].

Pewly may manually restrict, suspend, or terminate access where reasonably necessary because of:

  • A material breach of these Terms.
  • Illegal, fraudulent, abusive, or harmful use.
  • A credible threat to the security or operation of Pewly.
  • Attempts to access another church's data.
  • Use that materially disrupts the service or its providers.
  • Non-payment once billing has launched and payment is actually due.
  • A legal or regulatory requirement.

Where practical, Pewly will provide notice and a reasonable opportunity to correct a breach. Pewly may act immediately where delay could expose people, churches, data, or the service to material harm.

Church administrators may separately revoke individual team members' access. Revoking a team member does not close the church's workspace.

Termination or closure does not necessarily result in immediate deletion of all stored information. Retention and deletion requests are handled as described in the Privacy Policy. Pewly currently processes those requests manually.

Sections that by their nature should continue after termination—including ownership, disclaimers, liability limitations, and governing law—will continue to apply.

Disclaimer of warranties

To the maximum extent permitted by applicable law, Pewly is provided on an “as is” and “as available” basis.

Pewly disclaims warranties and conditions that are not expressly stated in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

Pewly does not warrant that the service will meet every church's requirements, that all defects will be corrected, or that every communication or automated care signal will reach its intended recipient.

Nothing in these Terms excludes a warranty, condition, or right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by applicable law, Pewly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of revenue, profits, goodwill, data, or business opportunity arising from or related to the service or these Terms.

To the maximum extent permitted by law, Pewly's total aggregate liability arising from or relating to the service or these Terms will not exceed the greater of:

  1. 1.The amount paid or payable to Pewly for the affected church workspace during the 12 months immediately preceding the event giving rise to the claim; or
  2. 2.CAD $100.

These limitations apply regardless of the legal basis of the claim and even if Pewly was advised that the loss was possible.

Nothing in these Terms limits liability where applicable law does not permit that limitation, including liability for fraud, wilful misconduct, or another liability that cannot legally be excluded.

Changes to these Terms

Pewly may update these Terms as the service, business, or legal requirements change.

The current version will be posted on Pewly's website with an updated effective date. If a change materially affects existing users' rights or obligations, Pewly will take reasonable steps to provide notice through the service or using the account contact information available to it.

Continued use after updated Terms take effect means you accept the updated Terms. If you do not agree to an update, you must stop using Pewly and may request closure of the workspace.

Governing law and general terms

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any rights that cannot lawfully be waived, disputes relating to these Terms or Pewly will be brought before the courts located in Ontario, Canada.

If part of these Terms is found unenforceable, the remaining provisions will continue to apply. Pewly's failure to enforce a provision is not a waiver of its right to do so later.

You may not assign these Terms without Pewly's written permission. Pewly may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the service, subject to applicable law.

These Terms and the documents they expressly reference form the agreement concerning your use of Pewly. They replace prior discussions or statements about the same subject, but do not replace a separate written agreement signed by both you and Pewly.
